      Description

      Good day, Dev-

      Amy Dillon retired 11/23 and her ACTIVE benefits went to 12/1/2016. She was then put into the retiree plan effective 12/1. This would be no gap in coverage; however, the 1095C is showing she wasn't offered or receiving benefits for December 2016. Please advise.

          Hi Raymond Williams,

          Employee was enrolled in Active Medical plan from Jan to Nov 2016. Hence employee is getting 1A & 2C code from Jan to Nov 2016.But on 11/24/2016, employee's status was changed to Terminated.
          As employee's status is changed to Terminated, Workterra system is giving 1H-2A code for the month of December.

          We had previously asked same question to ACA Auditors, According to them, 'If the plan is fully-insured, there is no Form 1095-C reporting requirement for years following year of retirement.'
          PFA mail communication for additional information. Let us know, if you need any additional information.

          This information was provided by the AE:

          The 1095C is stating she didn't have coverage, which she did. In addition our Blue Shield plan is not fully insured. Also, other retirees in this plan received 1095cs.

          We have verified same at our end once again. We have verified same for other employees e.g Roger S Hardin and Dagmar k. Sampson who were enrolled in same plan i.e EARLY RETIREE BLUE SHIELD PPO 200 STANDARD-Retiree Medical-CSAC EIA Blue Shield in Nov & Dec 2016 .These employees also received 1H 2A codes for Nov- Dec 2016. Even though employees are enrolled in self insured plan, employee's status has been changed to Retired. Please refer attached screen shot 'Post-employment (non-COBRA) coverage.png' and page 11/19 of document 'i109495c-2016.pdf' i109495c-2016.pdf for information.

          Let us know, if you have any other sample employee so that we can provide more analysis
